Careless and Reckless Operation in New Jersey
It is forbidden to operate a vessel in a careless or reckless manner i.e. in such a manner that endangers persons or property, or unnecessarily interferes with the free and proper use of any waters.
Anyone convicted of reckless or careless operation will be required to complete an approved boating safety course before their privilege is restored.
Operators must navigate in a reasonable and prudent manner at all times.
It is illegal to operate vessels in an unsafe manner.
Unsafe operation includes:

Operating a boat in a restricted or prohibited area

Operating a boat while under the influence of alcohol or drugs

Excessive speed near other boats

Not maintaining adequate distance (from water skiers, other vessels, etc.)

Hazardous water skiing practices

Overloading (i.e. exceeding the manufacturer’s capacity plate specifications)

Bowriding, or riding on a seatback or gunwale

Violating the safety zone (50 feet) around dive flags

Operating a vessel in an unsafe condition (e.g. with a fuel leak)
